These terms govern your access to and use of the Devin Media Corp API and any data accessed through it (“Data“, “API“). By accessing or using our API, you agree to these terms.

1. What This Is

Devin Media Corp provides API-based access to curated pre-1930 publication data. You do not receive copies of files. You do not download datasets. You connect to our API and retrieve data according to your license terms.

2. License Grant

We grant you a non-exclusive, worldwide, non-transferable, revocable license to access and use the Data via our API for the following purposes:

  • Internal Research & Analysis: Querying and analyzing Data for your internal business or academic purposes.

  • AI/ML Model Training: Using Data accessed via API to train, validate, or fine-tune artificial intelligence, machine learning, or large language models.

  • Product Development: Incorporating insights or model outputs derived from the Data into your commercial products or services.

  • Application Integration: Building applications that query and display Data to your end users, subject to rate limits and use restrictions.

3. Prohibited Uses

You may not:

  • Download or Scrape: Attempt to download, scrape, crawl, or otherwise copy substantial portions of the Data outside of normal API usage. Our API is designed for access, not bulk transfer.

  • Recreate the Dataset: Use API access to reconstruct, replicate, or redistribute our curated collections as a standalone dataset.

  • Remove Attribution: Omit or alter any provenance information, attribution, or metadata returned with the Data.

  • Sublicense or Resell: Resell, sublicense, or otherwise make the API or Data available to third parties as a competing service.

  • Exceed Rate Limits: Circumvent rate limits, access controls, or other technical restrictions we put in place.

  • Unlawful or Harmful Use: Use the API or Data in connection with any unlawful activity, hate speech, discrimination, or harassment.

4. API Access & Availability

  • Rate Limits: Your access is subject to rate limits based on your subscription tier. We will provide these limits separately.

  • Availability: We strive for high availability but do not guarantee uninterrupted access. We may perform maintenance, updates, or modifications that temporarily affect availability.

  • Changes: We may add, modify, or deprecate API endpoints over time. We will provide reasonable notice for significant changes.

  • Security: You are responsible for maintaining the security of your API keys and credentials. Notify us immediately of any unauthorized use.

5. Intellectual Property & Ownership

  • Our IP: The Data, including its curation, cleaning, organization, and provenance tracking, and the API itself, are the exclusive property of Devin Media Corp. The original source materials are pre-1930 and in the public domain, but our curated compilation, API infrastructure, and value-added processing are protected.

  • Your IP: You retain full ownership of any models trained, insights generated, or applications built using the Data, subject to these terms.

6. Attribution

If you publish or publicly release research, models, or analysis substantially based on our Data, we request that you credit Devin Media Corp as the data source (e.g., “Data accessed via Devin Media Corp API”).

7. Fees & Payment

Access is granted on a subscription or usage-based model, not per-file or per-gigabyte. Fees, tiers, and payment terms will be specified in your agreement or subscription plan. Fees are non-refundable except as required by law.

8. Data Disclaimer

THE DATA AND API ARE PROVIDED “AS IS” AND “AS AVAILABLE”. WE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THE DATA OR API, INCLUDING BUT NOT LIMITED TO WARRANTIES OF ACCURACY, COMPLETENESS, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. Historical materials may contain OCR artifacts or period-specific biases. You acknowledge that the Data is a historical artifact and assume all risk related to its use.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DEVIN MEDIA CORP BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE USE OF THE API OR DATA. OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Termination

We may suspend or terminate your API access immediately if you violate these terms. Upon termination, you must cease all use of the API and any Data in your possession (though models trained prior to termination may continue to be used). Any rights and obligations that by their nature should survive will remain in effect.

11. Governing Law

These terms shall be governed by the laws of [Your Province/State], Canada, without regard to its conflict of laws principles.
